What is trademark?
  • Trademark is a sign which represents the goods and services of your company. It allows the consumers to distinguish your goods and services from other good and service providers.
What can be trademark?
  • Conventional Trademark: Word, logo, Combination of word and logo;
  • Non-conventional Trademark: Colour, smell and sound;

Things to know before you Proceed your trademark application:
  • Classifications:     
    • Trademark are divided into 45 classifications. Each class representing similar goods and services.
    • Class 1 to Class 34: Goods
    • Class 35 to Class 45: Services
  • Distinctiveness:    
    • Trademark is registrable providing that the trademark is distinctive, in other words, the trademark must be NEW and CAPABLE OF DISTINGUISHING GOODS OR SERVICES with which the proprietor of the trademark is or may be connected in the course of trade. 
  • Jurisdiction Rights:
    • Trademark protection is limited to the coutries where the applications are filed.

IMPORTANCE OF TRADE MARK REGISTRATION
Intellectual Proprietary privileges in relation to a trade mark may be established through actual use in the marketplace and registration provides for:
  • Exclusive Rights:     
    • Registered trade marks owners have exclusive right to use their marks in trading. They also have the rights to take legal action for infringement under the Trade Mark Law against others who use their marks without consent. They can either take civil action or lodge complaints to Enforcement Division for appropriate actions under the Trade Description Act 1972.
  • Legal Evidence:     
    • Registration certificate issued by Registrar Office is a prima facie evidence of trade mark ownership. A certificate of registration serves as an important document to establish the ownership of goods exported to other countries.
